Will they take my home if my mortgage is discharged?

With the economy being so unbelievably bad, I am falling behind on my bills. I also have poor credit and was declined to refinance my mortgage. I think that bankruptcy is my best option and I think that I will pass the means test. Will my home be taken and foreclosed by the bank if I declare for bankruptcy? The reason that I ask is because I barely have enough to pay my mortgage but then I would have nothing for anything else.

You need to make an appointment with a bankruptcy attorney. Many questions need to be answered before I can correctly respond. Give my office a call.

You really need to see an attorney. If you want to keep the house, you need to pay the first deed of trust.
