What will bankruptcy do to my taxes?
What will filing a bankruptcy do to my taxes?
Karen E. Lockhart, PLC
That depends on your situation and the type of tax you are asking about. Income taxes that became due 3 years prior to filing can be discharged in many situations. Feel free to contact me for a free consultation to discuss your specific tax issues.

It really depends. Most taxes are not dischargeable in a bankruptcy. If your primary reason for filing bankruptcy is to discharge taxes, I would recommend you seek advice from a tax expert. You need an expert in taxation to look into your tax history in order to determine if taxes are dischargeable.

That is a very good question, regular income tax debts are dischargeable if they are "old enough" and meet a number of other requirements. This is a technical area of Bankruptcy Law, however, even if discharged, tax liens will remain on your property by the taxing authority. The result is that the taxing authority can't go after your bank account or wages, but you will have to pay off the lien before you can sell your real estate with a clear title. I would be willing to consult with you regarding this Bankruptcy matter.
